Welcome to Flawless Focus Digital Media, a d/b/a of Living Legacy Media LLC (“Flawless Focus Digital Media,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your use of our website and any services booked with us, including photography, videography, and photo booth services (collectively, the “Services”).

By accessing our website or booking our Services, you agree to be bound by these Terms. If you do not agree, please do not use our website or book our Services.

2. Use of Our Website

You agree to use our website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the site.

3. Booking, Consultations & Payments

All sessions and event services are subject to availability and are typically confirmed after a consultation.
Pricing for sessions, packages, and add-ons will be communicated on our website or directly during consultation.
A retainer/deposit may be required to secure a date and time. Retainers are typically non-refundable unless stated otherwise in your specific agreement or our Refund Policy.
Final payment terms (due dates, accepted payment methods, etc.) will be outlined in your invoice or service agreement.

If there is any conflict between these Terms and the specific terms in your signed contract, the signed contract will control for that engagement.

4. Cancellations, Rescheduling & Refunds

Our cancellation, rescheduling, and refund procedures are detailed in our Refund & Cancellation Policy, which forms part of these Terms.
By booking a session or event, you acknowledge that you have read and agree to the Refund & Cancellation Policy posted on our website or provided to you in writing.

5. Client Responsibilities

To help us deliver a smooth experience, you agree to:

Provide accurate information during booking and consultation.
Arrive on time and prepared for sessions or ensure timely access to venues and participants for events.
Secure any required permissions for locations (permits, venue approvals, etc.).
Communicate special requests (e.g., shot lists, must-have moments, restrictions) in advance of your session or event.

We are not responsible for delays, missed moments, or reduced coverage due to late arrivals, venue restrictions, or circumstances outside our control.

6. Artistic Style & Creative Direction

By booking our Services, you acknowledge that:

You have reviewed our portfolio and understand our style, approach, and artistic judgment.
While we do our best to honor reasonable requests, the final creative decisions (including lighting, composition, editing style, and selection of final images or video clips) are made at our discretion.
We do not guarantee the capture of any specific image, angle, or person, especially in dynamic environments like events and weddings.

7. Delivery of Images & Videos

Delivery timelines for images and videos will be communicated at or after booking and may vary depending on the nature of the project.
Final deliverables are typically provided via online gallery, download link, or other agreed-upon method.
Unless otherwise agreed in writing, raw, unedited image or video files are not provided.

8. Intellectual Property & Usage Rights

All photographs, videos, and other creative works produced by Flawless Focus Digital Media remain the intellectual property of Flawless Focus Digital Media unless otherwise stated in writing.
Clients are typically granted a personal, non-exclusive, non-transferable license to use the final delivered images and/or videos for personal use (sharing, printing, personal social media, etc.), subject to any restrictions outlined in your agreement.
Commercial use (e.g., advertising, brand campaigns, resale, or promotion beyond personal use) may require a separate license agreement and additional fees.
You agree not to alter, edit, or apply heavy filters to our work in a way that misrepresents our style or brand, unless we provide written permission.

9. Model Release & Promotional Use

Unless otherwise agreed in writing, you grant Flawless Focus Digital Media the right to:

Use images and video clips from your session or event for portfolio, website, social media, advertising, and promotional materials, both online and in print.

If you prefer to keep your session or event private, you must notify us in writing before your session or signing your contract, and we will do our best to accommodate reasonable requests.

10. Third-Party Services & Links

Our website may contain links to third-party websites or tools (e.g., booking platforms, payment processors, social media platforms). We are not responsible for:

The content, policies, or practices of any third-party websites.
Any losses or issues arising from your use of third-party services.

You are encouraged to review the terms and privacy policies of any third-party services you use.

11. Limitation of Liability

To the fullest extent permitted by law:

Flawless Focus Digital Media, its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of our website or Services.
Our total liability for any claim related to the Services will not exceed the amount you paid for the specific service or session at issue.

We are not responsible for:

Delays or failures caused by events beyond our control (e.g., illness, severe weather, equipment failure, emergencies, venue restrictions).
In such cases, we may offer rescheduling, a substitute photographer/videographer, or partial refunds/credits at our reasonable discretion and as outlined in your service agreement.

12. Indemnification

You agree to indemnify, defend, and hold harmless Flawless Focus Digital Media, its owners, employees, and contractors from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of:

Your use of the website or Services.
Your breach of these Terms.
Any violation of law or third-party rights by you or anyone using your account or booking.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top. Your continued use of our website or Services after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in or nearest to Orland Park, Illinois, unless otherwise required by law.
